By using or accessing any part of our services, you agree to all of the terms and conditions contained herein and all other operating rules, policies, and procedures that may be published from time to time on our site. If you do not agree to any of these terms, conditions, rules, policies, or procedures, do not use or access our services. Art Adventure Studio LLC reserves the right to modify or replace any of the terms or conditions of this TOS at any time at its sole discretion.

1. Your Registration Obligations

To be a registered user of our services, you agree to: (a) provide true, accurate, current, and complete information about yourself as prompted by the site registration form (the Registration Data). If you provide any information that is untrue, inaccurate, not current, or incomplete, or if Art Adventure Studio LLC has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, Art Adventure Studio LLC has the right to suspend or terminate all of your registrations and refuse any and all of your current or future use of the services (or any portion thereof). We reserve the right to refuse service to anyone for any reason at any time. Art Adventure Studio LLC is concerned about the safety and privacy of all its users, particularly children. For this reason, you must be at least 18 years of age, or the legal age of majority where you reside if that jurisdiction has an older age of majority, to register a minor for an event.

2. Privacy

You understand that your content (not including credit card information) may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

Any information submitted or provided by you (not including credit card information) to the services may be publicly accessible. You should take care to protect private information or information that is important to you. Art Adventure Studio LLC shall not be responsible for protecting any such information and is not liable for the protection of privacy of electronic mail or other information transferred through the internet or any other network that you may use. Please be aware that if you decide to disclose personally identifiable information on the services, this information may become public. Art Adventure Studio LLC does not control and shall not be responsible for the acts of you or any other users of the services.

You will need to get the permission of other students and your teacher to take photos of others’ work. Your instructor may take photos or short videos of the class throughout the day. These photos/videos may or may not be used for marketing purposes including (but not limited to) use on websites, social media, blogs, advertising, print media, and more.

3. Errors, Inaccuracies, and Omissions

Occasionally there may be information on our site or in the service that contains typographical errors, inaccuracies, or omissions that may relate to class descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information in the service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend, or clarify information in the service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the service or on any related website should be taken to indicate that all information in the service or on any related website has been modified or updated.

4. Refunds and Cancellation Policy

If you must cancel, for any reason, within 24 hours of registering, we will issue a full refund provided that the cancellation occurs a minimum of 30 days before the class/event. If you must cancel, for any reason, more than 24 hours after registering or within 30 days of the start of the program, no refunds or class credit will be issued. If the class strength is less than 3 students, the class instructors reserve the right to cancel the class. Students will be provided options to register for alternate classes, if feasible, or receive a refund of the registration fee paid.

5. Disclaimer of Warranties; Limitation of Liability

We do not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, or error-free and the State does not license the program. You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

You, on behalf of yourself and/or your child or children (the “Child”), understand and agree that Art Adventure Studio LLC, including but not limited to its representatives, employees, hired contractors/consultants, and art instructors, shall not be held responsible for any damages (personal injury, property, or other) arising and/or resulting from your and/or the Child’s participation, facility use, and/or involvement with Art Adventure Studio LLC. You, on behalf of yourself and/or the Child, further understand the inherent risk to you and/or the Child related to activity at Art Adventure Studio LLC, including but not limited to you and/or the Child’s use of art materials and supplies, and expressly assume such risk. You, on behalf of yourself and/or the Child, hereby waive and release Art Adventure Studio LLC, from and against any and all claims arising and/or resulting from your and/or the Child’s participation, facility use, and/or involvement with Art Adventure Studio LLC. You further agree to indemnify Art Adventure Studio LLC for costs, attorneys’ fees, judgments or settlements of any claim resulting from and/or associated with your and/or the Child’s participation, facility use, and/or involvement with Art Adventure Studio LLC.

6. Intellectual Property Rights

a. Ownership of Artwork:
By participating in any class or event at Art Adventure Studio LLC, you acknowledge and agree that all artwork created by you or your child during the class or event remains your or your child’s property.

b. License to Use Artwork:
You hereby grant Art Adventure Studio LLC a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, display, distribute, and create derivative works of the artwork created during the classes or events for internal purposes, including but not limited to, marketing, promotional materials, social media, website content, blogs, and advertising. This license includes the right to publicly display and share the artwork in any media format.

c. Attribution:
When requested by you, Art Adventure Studio LLC will provide appropriate attribution by including the artist’s name or initials when using the artwork for marketing and promotional purposes.

d. Consent and Release:
By participating in the classes or events, you consent to the use of the artwork as described above. If you do not wish for specific artwork to be used for these purposes, you must notify Art Adventure Studio LLC in writing at the time the artwork is created.

e. Moral Rights:
Nothing in this agreement shall be construed as a waiver of any moral rights you or your child may have in the artwork.

You have read the Terms and Conditions in its entirety and understand what you have read. You agree to abide by the Terms of Service established for this site.
